Benfica appeals Porto's UCL spot to the TAS

All of today's Portuguese Newspapers are stating that both Benfica and Guimaraes have appealed and Porto's spot isn't a sure thing.

See, there was a reason I was glad.

1. Como é público, a UEFA decidiu a 23 de Maio de 2008, de forma autónoma e seguramente devidamente sustentada, instaurar um processo disciplinar ao FC Porto em face das decisões proferidas pela Comissão Disciplinar da Liga e que condenaram o FC Porto e o seu Presidente por tentativa de corrupção.

2. Por decisão do Comité de Controlo e Disciplina da UEFA, proferida a 4 de Junho de 2008, o FC Porto foi excluído da UEFA Champions League 2008/2009.

3. A 10 de Junho de 2008, por ocasião do recurso interposto pelo FC Porto junto do Comité de Apelo da UEFA, a Benfica SAD e o Vitória Sport Clube foram chamados por este organismo a intervir no processo na qualidade de parte.

4. A Benfica SAD e o Vitória SC notificados do Acórdão emanado pelo Comité de Apelo da UEFA, no passado dia 16 de Junho de 2008, o qual se revelava ambíguo, decidiram interpor recurso para o Tribunal Arbitral do Desporto.

5. O FC Porto e a UEFA procuraram através de um expediente formal que este recurso não fosse admitido junto do Tribunal Arbitral do Desporto, invocando a ilegitimidade dos recorrentes. Esta pretensão não mereceu acolhimento.

6. Admitido o recurso, o Tribunal Arbitral do Desporto julgou-o, porém, improcedente, porquanto terá corroborado a posição da UEFA de que não existe ainda uma decisão final por parte dos seus órgãos jurisdicionais.

7. Desta decisão, cujo Acórdão fundamentado só será remetido nos próximos dias, podem-se antecipar desde já duas conclusões: o Acórdão proferido a 16 de Junho de 2008 pelo Comité de Apelo da UEFA permanece válido, logo o Comité de Controlo e Disciplina da UEFA mantém em aberto o procedimento disciplinar ao FC Porto, sem prejuízo de nova decisão não vir a ser proferida antes do início da próxima edição da UEFA Champions League 2008/2009.

8. A Benfica SAD regista com preocupação o facto de a UEFA desvalorizar, até à data, decisões proferidas ora por unanimidade, ora por maioria, por dois órgãos jurisdicionais desportivos, a saber a Comissão Disciplinar da Liga e o Conselho de Justiça da FPF.

9. Não pode deixar de merecer público reparo o facto de a UEFA ter anunciado, em momento anterior, que aguardava pelas decisões do Conselho de Justiça da FPF para tomar uma decisão final sobre o procedimento disciplinar instaurado ao FC Porto, vir, agora, manifestar dúvidas sobre a executoriedade das decisões proferidas por aquele órgão jurisdicional. A crítica deve ser tanto mais severa porquanto o argumento é inusitado e contraria os princípios que regem os próprios Estatutos da UEFA.

10. Esta conduta levou inclusive o Tribunal Arbitral do Desporto a condenar a UEFA no pagamento proporcional das custas do processo.

11. A sucessão de factos e decisões dilatórias acima descritas levam-nos a concluir que os procedimentos da UEFA contrariam as várias declarações públicas proferidas pelo seu Presidente.

12. Até serem conhecidos os fundamentos da decisão do Tribunal Arbitral do Desporto e bem assim quais os procedimentos que irão ser agora adoptados pela UEFA e pela FPF, a Benfica SAD não irá tomar qualquer outra posição pública, permanecendo, porém, atenta aos próximos desenvolvimentos.

13. Por último, a Benfica SAD enaltece a forma exemplar como o Tribunal Arbitral do Desporto conduziu este processo de recurso, permitindo às partes (todas elas) a exposição detalhada dos respectivos argumentos.

Like i said before Porto will play in this year Cl next year they will not be in the eurocups.

It's obvious now that, until this mess is resolved domestically, the corruptos are not going to be banned from the CL. Expect the circus to continue. Anything goes for them.

There's always a chance the sun will shine on a dog's ass, but I wouldn't count on it. At least not until the chubby version of Skeletor dies a premature death. But with black magic on his side, I wouldn't count on that either.

So that leaves beating them between the 'official' rectangle despite all and any PDC bought refs... like we used to do before JVA sent the club spiraling into financial ruin while he stuffed his own pockets.

1st step has been completed - getting the team out of fiscal ruin and stabilizing its finances. Slowly they've gained some of the fiscal leverage necessary to market the brand and operate in this modern environment.
